The answer to ALL your questions is a "qualified" yes -- he can install software that will packet sniff the MAC address of your NIC. He can then create logs of everything you do!
Fortunately for you, if your neighbor is so dumb that he can't secure his network from the likes of you -- I think your safe.
But then again, if he has a mean streak like me, he just may have set up a "Honey Pot" to intentionally catch people like you that steal bandwidth.
Armed with a Packet Log and your MAC address and the Laws of your country (whatever they may be) -- your neighbor "could" cause you all kinds of grief.
Use your own connection and don't steal from others and you will never run the risk of having a problem!
Google for "honey pot" -- it is generally a computer that is left exposed to "attackers" -- usually used by corporations but can be used by small users by leaving a computer exposed in the DMZ subject to all kinds of attacks.
In this case the entire LAN could be a "honey pot" OR the person could just be stupid.
